Terms of Service
The terms you agree to by using this website, requesting a free audit, booking a call, or joining the partner and referral programs.
1Agreement
This website is operated by Zolley, LLC, a Florida limited liability company ("Zolley", "we", "us"). By using zolley.com you agree to these Terms. If you do not agree, please do not use the site.
We may update these Terms. Material changes will be posted here before they take effect, and the date above will change.
2What this site is
zolley.com describes our services and lets you contact us, book a call, request a free audit, use our free tools, open a support ticket, refer a business, or apply to partner with us. It is a marketing and inquiry site.
Nothing on this website is an offer, a quote, or a contract. Prices are not published here on purpose: what you would pay depends on your market, your industry and the scope, and you get a real number on a call and in writing before anything starts. Any engagement is governed by a Master Service Agreement and a Statement of Work, not by this site.
Nothing here is legal, financial, tax or compliance advice. We build and run marketing systems. Where our services touch regulated ground (consent records, messaging compliance, accessibility), we build to the standards we describe, but that is not a substitute for your own professional advice, and using our tools does not by itself make you compliant with anything.
This site is meant for businesses in the United States. If you use it from somewhere else, you do so on your own initiative and are responsible for following the law where you are.
3Using the site
You agree not to use this site to do anything unlawful, and not to:
- Submit false information, or someone else's information without their permission
- Attempt to gain unauthorized access to any part of the site or our systems
- Interfere with the site's operation, or attempt to circumvent the bot protection on our forms
- Scrape, harvest, or automate submissions
- Use the site to send unsolicited messages of any kind
We may restrict or refuse access to anyone, at any time, without notice.
4Text messages and phone calls
If you give us a phone number and tick the consent box, we may text you. Full details are in our SMS Terms. In short: message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help, and messages come from (561) 915-1400.
Every form that asks for your phone number asks for this consent, because a phone number you give us is one we intend to use. Consent is not a condition of buying anything; if you would rather not give it, email us instead.
Phone calls. The same consent covers calls from us, including automated and prerecorded calls, to the number you gave. To stop them, tell the person who calls you or email [email protected]; any reasonable way of telling us counts. We keep an internal do-not-call list and stop calling within 10 business days at most.
5Free discovery call
You can book a fifteen-minute call. It is free and carries no obligation.
We will do our best to keep the appointment, and we may need to reschedule. If we do, we will tell you. Booking a call does not create a client relationship or entitle you to any particular advice or outcome.
6Free marketing audit and free tools
You can request a free written audit of your marketing. We aim to deliver it within two business days, by email, and we text you the link.
The audit is our opinion, given in good faith, based on what is publicly visible and what you tell us. It is not a guarantee of results, an appraisal, or professional advice. It is yours: act on it yourself, hand it to another agency, or ignore it. We ask for nothing in return.
We may decline to produce an audit, and we may stop offering it.
Free tools and downloads. The value calculator, the marketing readiness scorecard, the value worksheet and the lead vetting guide are free. The calculator and the scorecard work only from the answers you give them: what they show is an estimate and a general assessment, not a projection of what you will earn or a promise of what we can do for you. The worksheet, the guide, our articles and the glossary are general information about marketing. They are not legal advice, including where they discuss consent, texting or calling rules; for your own obligations, ask your own lawyer. We may change or withdraw any of them at any time.
7Support tickets
If you are a client, you can open a support ticket on this site. You get a ticket number immediately. Response times depend on your agreement.
You are responsible for what you upload. Do not attach anything you do not have the right to share, and do not attach passwords, card numbers, or other credentials; a support attachment is not a secure channel for secrets.
8Referral and partner programs
You can refer a business to us, or apply to become a partner.
Referrals. When an introduction becomes a client, we often pay a referral fee. Whether a fee is paid, how much, and how it is paid depend on what the client buys and are agreed with you in writing; they are not set by this website. Referring someone does not by itself entitle you to a payment.
Referring someone else's details. When you submit a referral you confirm you have that person's permission to give us their contact information. Please only refer people who are expecting to hear from us. We contact them once, mention you by name, and stop if they are not interested.
Partners. There is no fee to join. Everything else about a partner arrangement (commission rate, structure, duration, and any other terms) is agreed with you in writing before your first introduction. Nothing on this website sets those terms, and no arrangement exists until it is written down.
If you recommend us publicly. If you mention or recommend Zolley in public (a post, a review, a video, an article or a newsletter) while you are a partner, or while you could be paid for a referral, say so clearly in the same place, for example "I may be paid if you work with them." Federal Trade Commission rules require it, and so do we.
We may end a referral or partner arrangement in line with whatever was agreed in writing.
9Your information
How we handle what you give us is described in our Privacy Policy and Cookie Policy. Using this site means you understand how we handle it.
10Electronic communications
When you contact us or submit a form, you are communicating with us electronically, and you consent to receive communications from us electronically. Agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing.
Recorded calls and meetings. We may record and transcribe phone calls and video meetings, including with an AI assistant, and we say so at the start of each one. Staying on after that announcement is your consent to it. If you do not want it, say so and we will stop recording or end the call. The Privacy Policy explains what we do with recordings and how long we keep them.
11Children
This site is not directed at anyone under 18, and it is not directed at children under 13. We do not knowingly collect information from children. If you believe a child has given us information, email [email protected] and we will remove it.
12Intellectual property
The content of this site (text, design, graphics, code, and the Zolley name and logo) belongs to Zolley, LLC or its licensors. You may view and print pages for your own reference. You may not copy, republish, or use our content commercially without written permission.
Client names and marks appearing on this site are the property of those clients and appear with their permission.
13Third-party links
We link to other websites, including our own social profiles. We do not control them and we are not responsible for their content or their privacy practices. A link is not an endorsement.
14No affiliation
Where we name third-party platforms, tools, or advertising networks, we do so descriptively. We are not affiliated with, endorsed by, or sponsored by any of them unless we say so explicitly.
15Disclaimer
This site is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or secure, or that the information on it is complete or current.
We do not guarantee marketing results. Any example, case study, or client statement on this site describes what happened for that client. It is not a promise, a projection, or a typical result, and your outcome will depend on your market, your offer, your business, and factors outside anyone's control.
16Limitation of liability
To the fullest extent permitted by law, Zolley is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of this site.
17Indemnification
You agree to indemnify Zolley against claims arising from your use of this site, your breach of these Terms, or your violation of any law or third-party right, including claims arising from information you submit about someone else.
18Dispute resolution
Any dispute arising out of or relating to these Terms or this website will be resolved by binding arbitration under the Federal Arbitration Act, before a single neutral arbitrator administered by the American Arbitration Association in Palm Beach County, Florida. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Individual claims only. You and Zolley each agree to bring any claim only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
19Termination
We may suspend or end your access to this site at any time, for any reason, without notice. The sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.
20General terms
If any provision of these Terms is unenforceable, the rest stand. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these Terms; we may assign them, including to a successor in a merger or sale of our business. These Terms, together with the Privacy Policy, Cookie Policy and SMS Terms, are the entire agreement between you and Zolley regarding this website. Where you have a signed Master Service Agreement, Statement of Work, or the Platform Terms, those govern the services described in them and prevail over these Terms to the extent of any conflict.
